MMD Privacy Statement

What does this privacy statement cover?

This website is committed to protecting the privacy of its visitors.

The purpose of this privacy statement (‘Statement’) is to inform you about the way that your personal data are processed in the frame of the use of the online services available on our website mediamarketingdelhaize.be (“Website”). Data processing is carried out in accordance with the General Data Protection Regulation (AVG) and all other applicable privacy and data protection legislation. By "personal data" MMD understands any information about an identified or identifiable natural person ("Data Subject").

Your identification and contact information will NOT be shared with third parties for commercial purposes under any circumstances. Commercial communications will only be sent out by an internal department within the Delhaize company structure, were MMD takes part from (more information can be found in the title ‘with whom does MMD share’ here below). Only if you have given your prior consent to receive offers from partners from MMD (for example external agencies), you will receive this type of direct marketing.
Your personal data will in principle be stored within the EU. If MMD cooperates with service providers based outside the EU, MMD has put in place the necessary safeguards to ensure that they protect your data appropriately and you can always exercise your rights.

To whom is this Statement addressed?

This Statement concerns the processing of personal data of our clients (retailers, suppliers, vendors,..), prospects or people demanding information about the services of MMD.
 

Who is responsible ?

Points Plus Punten SA, acting under its Brand name “Media Marketing Delhaize” (“MMD”), registered with the Crossroad Bank of Enterprises under number 0459.349.042, whose registered address is Brusselsesteenweg 347 - B-1730 Asse. MMD works with a media agency for the management of the Website, and with an internal department for sending commercial communications to you.  MMD guarantees that your personal data are always processed in a secured and adequate manner.

Media Marketing Delhaize (‘MMD’) takes your privacy and data processing rights seriously.

You can always contact the data protection lead at dataprotection@delhaize.be. If you have any questions regarding your rights, MMD does ask that you contact their department first at mmd@delhaize.be.
 

Which personal data?

MMD ensures that your personal data is processed in accordance with applicable laws, in an adequate, relevant manner and that such processing is limited to what is necessary for the purposes of the processing.

You may share with us your name, first name, company name, gender, phone number (optional), e-mail address and language preference. An email address which only contains the company’s information shall not be seen as personal data.  The data are necessary for the access and the use of the services available on the Website and for the MMD newsletter. You may not be able to use our services otherwise. In case of an event the abovementioned data shall also be registered to the event and a function or title will be asked as well.  MMD will retain your personal data as long as necessary and up to maximum 5 years after the last contact with you. More specification concerning this retention period can be found in title ‘data retention’ here below.

MMD does not collect or process special categories of personal data unless MMD has received your explicit consent to do so or are required to do so by a legal provision.

If you decide to enter into an agreement with MMD, then MMD also processes the information related to the agreement.
 

For what purposes?

MMD collects and use personal data only for specific, explicitly defined, and legitimate purposes and thus will not further use data in a way incompatible with those purposes.

The possible legal grounds are:

  • Legitimate interest: In certain situations, the processing of personal data is necessary for the pursuit of MMD's legitimate interests. In those cases, MMD will weigh and verify that your interests or your fundamental rights and freedoms as a customer are not overriding;
  • Necessary for the performance of an agreement. Your personal data will be processed for the execution of an agreement you have entered with MMD or for the exercise of pre-contractual measures taken at your request;
  • Consent. MMD will seek consent to use your personal data for certain purposes (such as for sending commercial messages/direct marketing).
     

If MMD processes your data based on your consent, you can withdraw it at any time via the link “unsubscribe” at the bottom of an email.

If MMD processes your data based on our legitimate interest, you can always indicate that your interest is overriding and object to the processing of your data .

MMD processes your personal data for the purposes of rendering the online services, including the generation of reports and statistics on your use of the services (because MMD has an interest to assess and improve our offering). MMD will also use your personal data to contact you after a period of inactivity of 1 year (more information in title ‘data retention’).
 

With whom does MMD share? 

If necessary for the purposes for which your personal data is processed, MMD may disclose your personal data to other entities within Delhaize, which consists of the Delhaize Le Lion/De Leeuw Comm. VA and its subsidiaries. A list of these subsidiaries can be delivered on demand. These entities will use the data only for the same purpose as stated in the Privacy Statement.

Obligatory transfers

In certain cases, MMD is required to transfer personal data about you.

This is the case when a law, regulation, or judicial proceeding (such as a court order) requires us to do so or when government agencies or police departments request us to do so in connection with law enforcement actions. MMD may also believe that in order to prevent physical harm or financial loss or in connection with an investigation of suspected or actual fraud or illegal activity, it is necessary or appropriate to transfer information about you.

Other Cases

If all or part of our business or assets are sold or transferred, MMD reserves the right to transfer all data about you. In this case, MMD will make the necessary efforts to ensure that the transferee uses your data in a manner consistent with this Privacy Statement. In the event of such a transfer, you should contact the transferee with any questions about your processing of the data.
 

Data Subject rights

MMD is committed to transparency, not only with respect to the way MMD processes your personal data, but also with respect to the rights you can exercise with respect to the processing of your personal data. Therefore, MMD would like to remind you of the existence of your rights and how you can exercise them at MMD in the following paragraphs.

MMD undertakes to respond to your request without delay and in any event within one month of receipt of your request regarding one of the rights listed below. Your request will be deemed to have been received at the time when your request is complete, which includes obtaining from you proof of identity in accordance with the procedure described below, or otherwise obtaining assurance of your identity. Depending on the complexity of the request and the number of requests, this period may be extended by two months if necessary. In that case, MMD will, in any event, notify you of such extension as soon as possible after receiving the request.


=> right of access to your data

First of all, you have the right to obtain access to the personal data that MDD processes about you.

According to the law, you also have the right to obtain information about the processing purposes; the categories of personal data concerned; the categories of recipients of personal data; if possible, the period for which the personal data is expected to be stored, (or if that is not possible, the criteria for determining that period); the right to rectification or erasure, the right to restriction of processing and the right to object to the processing of your personal data; the right to lodge a complaint with the supervisory authority (being the Belgian Data Protection Authority); the source of the data if it was not collected from you; the existence of automated decision-making including profiling; and the safeguards taken to protect personal data in case it is transferred to a third country or an international organization.

To access and obtain a copy of the information MMD processes about you, you can contact the MMD department via mmd@delhaize.be. When you contact our department, we can verify your identity to prevent your data from being disclosed to unauthorized third parties.


=> right to rectification, restriction, and erasure of your data

You have the right to correct or have corrected your personal data if it is incorrect.

You have the right to request the restriction of the processing of your personal data, i.e. to stop the processing of your personal data without having it removed from our databases. This right can only be used in the cases provided for by law, for example, during the period when we are checking the accuracy of disputed data, or while waiting for a response to your objection.

You also have the right to request the deletion of your personal data in the following cases:
- If the personal data is no longer necessary for the purpose for which it was collected or processed;
- If you withdraw the consent on which the processing of personal data is based and there are no other legal grounds for the processing;
- If you object to the processing of your personal data and there are no overriding compelling legitimate grounds for the processing;
- If your personal data is processed in an unlawful manner;
- If your personal data must be erased to comply with a legal obligation.

=> right to data portability

You have the right to obtain the data you have provided to us in a structured, commonly used, and machine-readable form and to further transfer it if the processing of personal data is based on consent and carried out by automated means.

=> right to (withdraw) consent to the use of data for direct marketing

Pursuant to the General Data Protection Regulation and the ePrivacy Regulations, MMD requires your specific, prior consent to send you direct marketing via electronic communication (such as email, text message, etc.). However, you have the right at any time thereafter, free of charge and upon first request, to withdraw your consent to the use of your data for direct marketing purposes.

=> right to oppose the use of data for other purposes

You have the right to object at any time, for reasons related to your specific situation, to the use of your personal data, if these are used and processed by us to serve our legitimate interests.

As soon as you exercise your right to object, MMD will stop processing your personal data unless MMD can provide compelling legitimate grounds to still process the data, which outweigh your interests as a customer; or if MMD may need your data in the future for the establishment, exercise or substantiation of a legal claim.

=> Right to lodge a complaint with a supervisory authority

You always have the right to complain to a supervisory authority. This will probably be the Belgian Data Protection Authority, whose contact details can be found at www.gegevensbeschermingsautoriteit.be.
 

Data retention

MMD does not keep your data longer than necessary for the purposes for which it was collected. The retention period depends on the purpose for which personal data is collected. MMD therefore uses the purpose as one of the criteria for determining how long MMD keeps your personal data. Other criteria may include, for example, our legal obligation to keep your data for a legally defined period of time or the length of time for which MMD enters into a customer relationship with you or provide services to you. Furthermore, MMD will retain your personal data for a maximum of 5 years from the date of the last time you opened the MMD newsletter. MMD has the possibility to track interest in the sent-out newsletters. MMD will however already contact you after 1 year of inactivity (meaning not opening the newsletters anymore) to check if you still want to receive our newsletter(s) or not. If , and only in that circumstance, MMD fails to get a clear answer from you, the data will automatically be deleted after 5 years, as already mentioned above.

MMD undertakes, at the end of the retention period, to securely erase, destroy or anonymize personal data that is no longer needed for the purpose for which it was collected.
 

Data security

MMD makes every effort to secure your personal data as best as possible and to protect your privacy as much as possible. MMD ensures that your personal data is protected by appropriate, technical, and organizational security measures against accidental, unlawful, or unauthorized destruction, loss, alteration, access, disclosure or use. Only employees within MMD, who need to have this access in order to carry out their assignment, are granted access to your personal data.
